Medical Need

Q: Are there medical requirements to receive the benefit? It seems as if the “Medical Statement for Consideration of Aid and Attendance” covers a very broad list of issues that might require the need for “aid and attendance of another person on a regular basis?”

A: Yes. The benefit was designed for those that truly need it. Only a physician is qualified to substantiate these needs. The DVA will require a Medical Statement (DVA Form VDVA 10) to be completed by a physician of your choice.

Q: Will residency in an Assisted Living Community, Memory Care Community, Skilled Nursing and Rehabilitation Community or Nursing Home generally substantiate the need for “aid and attendance?”

A: Generally, this will satisfy this requirement, but not always. Remember, only a physician can substantiate this need.

Q: Can I still receive this benefit if I am living independently in my own home or a retirement community?

A: Absolutely, as long as there is substantiated need as determined by your physician and you have a Caregiver as well as a Caregiver Agreement.

Q: Who can be a Caregiver? What is a Caregiver Agreement?

A: A Caregiver can be anyone other than a spouse and they do not have to be licensed. A Caregiver Agreement is a written statement signed by both parties that will briefly outline the services that will be provided and the remuneration for those services. The DVA will require written documentation that such services will be performed

Q: What if we require forms and or documents?

A: That is what our organization does. We assist, advise, coach and help. We offer, clear, concise and correct information. Furthermore, we do it all at no charge to the veteran or the communities in which they reside.

Financial Requirements

Q: We have heard that the DVA has certain financial formulas that are used to determine benefit awards? How do these work?

A: The DVA uses a mathematical formula to determine need. The application forms require a complete disclosure of income/expenses and assets.

Q: Will Veterans Angels help us with these forms?

A: We will assist you with all of the forms. Be prepared to provide financial information regarding income and assets. Stephen Stone, our CEO, is a Registered Investment Advisor and will offer his expertise free of charge.

Q: With regards to a “look-back” period, does the DVA have one in relation to Aid and Attendance?

A: They do; however, it is only 24 hours prior to the submission of the claim.

General Questions

Q: Stephen Stone, the CEO of Veterans Angels, Inc. is listed as an Accredited Representative, via the Marine Corps League, with the Department of Veterans Affairs. Why is this important?

A: As of June 23, 2008, the VA began requiring that anyone who assists a veteran or family member with the preparation, presentation and prosecution of a claim for benefits be accredited by the VA before they can legally provide assistance. So, it is for your protection to make sure you are using an Accredited Agent.

Q: Couldn’t we just do this on our own?

A: Of course! You can do this on your own for free, or you can ask Veterans Angels, Inc. to assist you for free. We’re not bragging, but we’re really good at what we do!

Getting Started

Q: So how do we get started?

A: You must complete the online Applicant Information Form. Click here to complete the Applicant Information Form.

Q: What documents will we need?

A: Veterans will need their DD 214’s or Separation Papers (originals or certified copies), as well as any financial documentation. Surviving spouses will need DD214’s or Separation Papers (originals or certified copies) a Marriage Certificate and a Death Certificate along with financial documentation. We will help you acquire the Separation Papers/DD214’s if you do not have them.

Q: How long does the process take?

A: Once the necessary documentation is compiled and we submit the application, it generally takes the DVA 3-6 months to acknowledge an award, sometimes longer. However, the claimant will receive the first benefit retroactive to the first of the month following submission. After that, all deposits will be received monthly by EFT, just like Social Security.
